Terms of Service

EonMailer is a product of Intuitix ( intuitix.ai ). These Terms are an agreement between you and Intuitix Nexis Private Limited (“we”, “us”, or “our”).

By accessing https://eonmailer.com or using EonMailer at https://app.eonmailer.com, you agree to these Terms. They’re written for agencies running multi-client email — including the pains around spam, provider bills, and who is allowed to change paid plans.

Problems these terms clarify

  • “Who pays the ESP?” — You (or your client) own the provider relationship and send cost. We provide the software desk.
  • “Can we spam?” — No. Unlawful or abusive sending is a breach; you must have rights and consents for contacts you process.
  • “Who can change billing?” — Plan changes are part of the paid service under the agency owner’s account; fees follow the Pricing page limits.

The service

EonMailer provides agency software to manage email marketing workflows, client workspaces, and related features. Sending is typically performed through providers you connect (BYO). Provider fees are between you (or your clients) and that provider.

Accounts

You must provide accurate registration information and keep credentials secure. Agency owners are responsible for seats, billing, and user permissions under their account.

Acceptable use

  • No unlawful, deceptive, or abusive email practices.
  • Comply with anti-spam and privacy laws applicable to your campaigns.
  • Do not attempt to disrupt or reverse engineer the service except as allowed by law.

Customer content

You retain rights to content you upload. You grant us a limited license to host and process that content solely to provide the service. You represent you have the rights and consents needed for contacts and campaigns you run.

Fees

Paid plans are billed via our payment processor. Plan limits (clients, seats, platform events) are described on the Pricing page and enforced in-product. Taxes may apply.

Disclaimer & liability

The service is provided “as is.” To the fullest extent permitted by law, we disclaim warranties and limit liability for indirect or consequential damages. Our aggregate liability for paid accounts is limited to fees paid in the three months preceding the claim.

Termination

You may stop using the service at any time. We may suspend or terminate for breach, abuse, or risk to the platform. Provisions that should survive (fees owed, liability limits) will survive.

Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless mandatory local consumer law provides otherwise. Courts in India shall have exclusive jurisdiction, subject to any non-waivable rights you may have.
